محمود مسائلی – هموطنان گرامی، همانگونه که مطلع هستید در تاریخ ۵ ژوئیه شکایتنامهای از سوی چهار کشور کانادا، انگلستان، سوئد، و اوکراین درباره ساقط شدن هواپیمای اوکراینی توسط موشکهای سپاه پاسداران انقلاب اسلامی به دادگاه بینالمللی دادگستری تسلیم شد. من این شکایتنامه را با دقت خواندم و معتقد هستم که استدلالهای حقوقی مندرج در آن نمیتواند دربرگیرنده اجرای عدالت باشد. به همین دلیل ضمن ارائه استدلالهای حقوقی بینالملل به وزیران خارجه ۴ کشور یاد شده، از آنها خواستم توضیح دهند چرا بنیادهای حقوقی شکایتنامه تسلیم شده به دادگاه بینالمللی ضعیف، ابهامآلود و گنگ است.
متن زیر درواقع ترجمه فارسی نامهای است که برای وزیران خارجه چهار کشور یاد شده ارسال نمودهام (البته فقط کپی مربوط به وزیر خارجه کانادا را ضمیمه ساختهام). تقاضا می کنم اولاً برای درک صحیح استدلالها به متن انگلیسی نامه مراجعه فرمایید زیرا ممکن است متن فارسی نتواند حق مطلب را ادا کند. ثانیا، این نامه را به نوعی با نمایندگان پارلمان، روزنامهها، و افراد با نفوذ در میان گذاشته و از آنها درخواست نمایید دولتهای خود را وادار به پاسخگویی نمایند. آنها باید بگویند چرا شکایتنامه تا این اندازه ضعیف تهیه شده است.

من این افتخار را دارم تا پس از مطالعه دقیق و کامل شکایتنامه چهار کشور کانادا، پادشاهی سوئد، اوکراین و بریتانیای بریتانیای کبیر و ایرلند شمالی علیه جمهوری اسلامی ایران که در تاریخ ۵ ژوئیه ۲۰۲۳ تسلیم دادگاه بینالمللی دادگستری شده است، این نامه را که حاوی استدلالهای حقوقی است خدمت شما تقدیم کنم.
با تشکر از همه تلاشهای چهار کشوری که پرونده سرنگونی هواپیمای اوکراینی PS752 را برای اجرای عدالت به دادگاه بینالمللی دادگستری ارسال کردهاند، به نظرم نکاتی گنگ و ابهامآلود در این شکایتنامه وجود دارد که آنها را به شرح زیر توضیح میدهم.
۱. دلایل قانونی مندرج در ادعای متقاضیان بر ماده ۱ از مقاولهنامه مونترال مصوب سال ۱۹۷۱ قرار داده شده و سپس مواد ۶، ۷، ۱۰، ۱۱، و ۱۳ را نیز در بر گرفته است. طبق این درخواست، جمهوری اسلامی ایران مجموعهای از تعهدات مربوط به منع اقدامات غیرقانونی علیه ایمنی هوانوردی غیرنظامی موسوم به مقاولهنامه مونترال را نقض کرده است. نکته مبهم در شکایتنامه چهار کشور این است که این مقاولهنامه فقط افراد را مسئول ارتکاب عمل خلاف ایمنی هواپیمای کشوری میداند. بنابراین نمیتواند عدالت را در قبال قربانیان حادثه جنایتکارانه سرنگون ساختن غمانگیز هواپیما توسط موشکهای سپاه پاسداران انقلاب اسلامی اجرا کند. در حقیقت، مقاولهنامه مونترال دربرگیرنده ابعاد حقوقی حاصل از عمل خلاف یک فرد میباشد و نه اقدام جنایتکارانه توسط یک دولت. موضوع فراموش شده در شکایتنامه این است که میبایست اساس دعوی را بر مقاولهنامه شیکاگو مصوب سال ۱۹۴۴ قرار میداد. این مقاولهنامه اخیر کشورهایی که از سلاح نظامی علیه هوانوردی غیرنظامی استفاده کردهاند (و نه لزوماً افراد خاص) را مسئول میداند. متمّم ماده ۳مقاولهنامه شیکاگو صراحت دارد که:
کشورهای متعهد اذعان دارند که هر کشوری باید از استفاده از سلاح علیه هواپیماهای غیرنظامی در پرواز خودداری کند، و در صورت رهگیری، جان افراد داخل هواپیما و ایمنی هواپیما نباید به خطر بیفتد. این ماده نباید به هیچ وجه تعدیل کننده حقوق و تعهدات کشورها به موجب منشور ملل متحد تفسیر شود.
نقطه کور در شکایتنامه این است که اگر جمهوری اسلامی ایران دستور دادگاه را بپذیرد، فقط مسئولین اتفاق جنایتکارانه میبایست تحت تعقیب قرار گیرند و نه خود جمهوری اسلامی! نکته این است که جمهوری اسلامی ایران پیش از این اعلام کرده بود که ۱۰ تن از نیروهای سپاه پاسداران انقلاب اسلامی در دادگاههای داخلی تحت تعقیب قرار گرفتهاند (ماده ۶ مقاولهنامه مونترال).[۱] در اینصورت هیچ دلیلی برای شکایتنامه چهار کشور در دیوان بین المللی دادگستری باقی نمیماند.[۲]
اینجاست که ارجاع به متمم ماده ۳ مقاولهنامه شیکاگو ضروری و اجتنابناپذیر میشود. به موجب این ماده، استفاده از تسلیحات علیه هواپیماهای غیرنظامی مستلزم مسئولیت کیفری یک کشور (و نه یک فرد یا افراد) است. لازم به ذکر است که مقاولهنامه مونترال (که مبنای حقوقی شکایتنامه میباشد) حاوی هیچ مادهای در مورد استفاده از سلاح علیه هواپیماهای غیرنظامی نیست. این بدان معناست که شکایتنامه چهار کشور مسئولیت جنایی سرنگونی ساختن هواپیمای غیرنظامی را به امری حقوقی تنزل میدهد.[۳]
۲. استفاده از سلاح برای سرنگون ساختن هواپیمای غیرنظامی در شرایط تشدید تنش بین جمهوری اسلامی ایران و آمریکا که در پی هدف قرار دادن و کشته شدن سردار قاسم سلیمانی توسط پهپاد آمریکایی در نزدیکی فرودگاه بینالمللی بغداد در عراق در ۳ ژانویه ۲۰۲۰، نگرانی دیگری را نسبت به مفاد و بنیادهای حقوقی شکایتنامه یادشده ایجاد میکند. در آن دوره بحرانی، سرنگون ساختن هواپیمای اکرایینی باید در پرتو باید ماده ۵۲ پروتکل اول الحاقی به مقاولهنامه ژنو سال ۱۹۴۹ مورد مطالعه قرار گیرد. بر اساس این ماده، «اشیاء غیرنظامی نباید هدف حمله یا تلافیجویانه باشد. اشیاء غیرنظامی همه اشیایی هستند که طبق تعریف موضوع اهداف نظامی نیستند»[۴].
در نظریهها و رویههای حقوقی، ماده مذکور به عنوان یک قاعده آمره پذیرفته شده است. یعنی قواعدی که هیچگونه انحرافی تحت هیچ شرایطی از آنها نباید وجود داشته باشد. در اینجا بحث اصلی این است که ممنوعیت استفاده از تسلیحات علیه اهداف غیرنظامی مانند هواپیماهای غیرنظامی نقض فاحش قواعد آمره بینالمللی به حساب میآید. درواقع، بطور عمده هیچ سلاحی نباید علیه یک هدف غیرنظامی مورد استفاده قرار گیرد. در این ارتباط است که مفاد ماده ۵۲ پروتکل اول الحاقی به مقاولهنامه ژنو سال ۱۹۴۹ با محتوای متمّم ماده ۳ مقاولهنامه شیکاگو پیوند پیدا میکند. این پیوند به درستی ابعاد جنایی سرنگون ساختن هواپیمای اکرایینی PS752 را اثبات میکند. از این رو ارجاع به ماده ۱ مقاولهنامه مونترال در شکایتنامه مذکور مبنای محکمی برای محکوم کردن عمل غیرقانونی و آگاهانه جمهوری اسلامی ایران در سرنگون ساختن هواپیمای غیرنظامی نیست.
۳. شورای امنیت سازمان ملل متحد در قطعنامه شماره ۱۰۶۷ سال ۱۹۹۶ وظیفه کشورها به رعایت مفاد متمم ماده ۳ مقاولهنامه شیکاگو را مورد باز تایید قرار میدهد. شورا تأیید میکند که نقض چنین تعهد قانونی و هنجاری از حقوق بینالملل مستلزم مسئولیت بینالمللی کشورها میباشد:
کشورها باید از استفاده از سلاح علیه هواپیماهای غیرنظامی در حال پرواز خودداری کنند و در هنگام رهگیری هواپیماهای غیرنظامی، جان افراد داخل هواپیما و ایمنی هواپیما نباید به خطر بیفتد[۵].
بر اساس قطعنامه مذکور، همه طرفین مقاولهنامه شیکاگو باید قوانین بینالمللی هوانوردی غیرنظامی و رویههای بینالمللی مورد توافق، از جمله قوانین و استانداردها و رویههای توصیه شده مندرج در کنوانسیون شیکاگو را به رسمیت بشناسند و از آن تبعیت کنند. این قطعنامه همچنین ملاحظات بنیادین انسانی و قواعد حقوق بینالملل عرفی را که در متمّم ماده ۳ مقاولهنامه شیکاگو مدون شدهاند، و استانداردها و شیوههای توصیه شده مندرج در ضمائم آن مقاولهنامه را یادآوری میکند. شورای امنیت از همه کشورهایی که تا کنون این کار را انجام ندادهاند، درخواست میکند که در اسرع وقت پروتکل الحاقی دربرگیرنده متمّم ماده ۳ مفروض در مقاولهنامه را تصویب کنند.[۶]
۴. اگرچه حقوق بینالملل اصل «متعلقات»[۷] به شرح مندرج در ماده ۱ مقاولهنامه شیکاگو را تأیید میکند، اما این اصل مطلق نیست زیرا در موارد خطرناک باید محدودیتهایی بر آن اعمال شود. در نتیجه، جمهوری اسلامی ایران میتوانست، و میبایست، محدودیتهایی را برای استفاده از حریم هوایی در زمان بحران و تنش که امکان برخوردهای نظامی در آن بسیار بالا بود، اعمال میکرد. ایران میبایست تعیین میکرد که کدام مسیرهای هوایی و در کدام حداقل ارتفاع هواپیماها میتوانستند در آن حریم هوایی پرواز کنند. گزارشگر ویژه سازمان ملل در گزارش مورخ ۲۴ دسامبر ۲۰۲۰ به نقل از فرمانده نیروی هوافضای سپاه پاسداران انقلاب اسلامی نقل میکند که گفته بود: «ما بارها درخواست کرده بودیم که حریم هوایی کشور بر روی پروازها قطع شود». اما این اتفاق نیفتاد و پروازها ادامه یافت. بر اساس همین گزارش، دولت جمهوری اسلامی ایران هیچ اطلاعیهای[۸] درباره خطرات نظامی احتمالی در فرودگاه «امام خمینی» صادر نکرده است.[۹] این موضوع سیار حیاتی در شکایتنامه تسلیمی به دادگاه بینالمللی دادگستری توسط چهار کشور نادیده گرفته شده است.
۵. اسناد الحاقی ۱۴گانه به مقاولهنامه شیکاگو استانداردهایی را برای تضمین ایمنی پروازهای غیرنظامی، از جمله طراحی برنامههای آموزشی مناسب برای افرادی که در صنعت هوانوردی کار میکنند، با هدف بهبود شیوههای عملیاتی ایمن را تعیین کرده و توضیح میدهند.[۱۰] دولت ایران این مقررات را که مستلزم ارزیابی خطرات احتمالی است، رعایت نکرده است. همچنین دولت جمهوری اسلامی ایران میبایست تعیین میکرد کدامین مسیر هوایی برای هواپیماهای کشوری امن هستند. مطابق با پیشنویس مواد مربوط به مسئولیت کشورها در قبال اعمال نادرست بینالمللی،[۱۱] چنین قصوری موجبات کشور (و نه یک شخص که مورد استناد مقاولهنامه مونترال است)، را به دنبال دارد. شکایتنامه یادشده توسط چهار کشور، این موضوع مسئولیت بینالمللی کشورها را نادیده گرفته است.[۱۲]
۶. در قضیه فعالیتهای نظامی و شبهنظامی در نیکاراگوئه و علیه نیکاراگوئه، دادگاه دادگستری بینالمللی، اهمیت قواعد حقوق بینالملل عرفی را یادآور شده و تاکید میکند که این قواعد بر ملاحظات اساسی انسانی تأکید دارند. اینها قواعدی هستند که در زمان صلح مهمتر و دقیقتر از شرایط جنگ میباشند: «این یکی از اصول بنیادین حقوق بینالملل است که در مورد ایمنی اشیاء غیرنظامی قابل اجرا است. برخی از اصول کلی و شناخته شده، یعنی ملاحظات اساسی انسانی، در زمان صلح خیلی مهمتر از شرایط جنگی هستند».[۱۳] بنابراین جمهوری اسلامی ایران مسئول نادیده گرفتن (یا نقض) آشکار آن اصول بنیادین حقوق بینالملل است که توسط رویههای قضایی دادگاه بینالمللی دادگستری هم تایید شدهاند.
۷. مشاور ویژه نخست وزیر کانادا، جناب آقای رالف گودیل، در گزارش خود در باره ساقط ساختن هواپیمای اوکراینی تأیید میکند که کانادا با پیگیری غرامت کامل از سوی جمهوری اسلامی ایران برای قربانیان، با جدیت به تلاشهای خود برای اجرای عدالت ادامه خواهد داد. او ادامه می دهد که این هواپیما سرنگون شده است که طبیعتاً به موجب متمّم ماده ۳ مقاولهنامه شیکاگو نقض آشکار قوانین بینالمللی است. این نقض آشکار در قطعنامه ۱۰۶۷ شورای امنیت سازمان ملل متحد که بر عدم استفاده از سلاح علیه هواپیماهای غیرنظامی تاکید شده است، نیز تصریح میکند.[۱۴] این گزارش گواه روشنی از جنایتی بینالمللی است که در اثر سرنگون ساختن هواپیمای مذکور شکل گرفته است. بنابراین نباید ماهیت این جنایت به یک حادثه هوایی صرف بر اساس مقاولهنامه مونترال تنزل داده شود.

من معتقدم که شکایت نامه مذکور فاقد دلایل قانونی قوی علیه جمهوری اسلامی ایران برای سرنگون ساختن هواپیمای اوکراینی میباشد. درواقع، دامنه موضوع گستردهتر از آن مبانی قانونی است که در شکایت چهار کشور توضیح داده شده است. اشاره به کنوانسیون مونترال فقط یکی از مبانی دعوی میباشد. دلایل و مبانی دیگری که در بالا ذکر شدند، در دادخواست ارائه شده علیه جمهوری اسلامی ایران ذکر نشده و توضیح داده نشدهاند. این امر میتواند تأثیرات نامطلوبی بر حقوق خانوادههای قربانیان هواپیمای ساقط شده داشته باشد، و از این رو نمیتواند عدالت را نسبت به قربانیان و خانوادههای آنها جاری سازد.
ضروری است که وزارتخانه تحت مدیریت شما به تعهدات حقوق بینالملل پایبند باشد. متواضعانه خواستار توضیح چرایی عدم توجه به دلایل یادشده بالا در شکایتنامه علیه جمهوری اسلامی ایران هستم. هموطنان کانادایی- ایرانی من و همچنین سایر ایرانیان مقیم خارج کشور اغلب از من درخواست میکنند در این مورد برای آنها توضیحاتی ارائه دهم. من باید پاسخ روشنی به درخواست آنها بدهم.
خوشحال میشوم در مورد این موضوع بیشتر با شخص شما یا اعضای حوزه مدیریتی شما دیدار و گفتگویی داشته و این دلایل را مفصلتر توضیح دهم.

Subject: Application instituting proceedings by four countries against the I.R. of Iran
Dear Honorable Joly,
I have the honor to write regarding the application instituting proceedings by Canada, Kingdom of Sweden, Ukraine, and the United Kingdom of Great Britain and Northern Ireland against the Islamic Republic of Iran on 5 July 2023.
Grateful of all efforts by the four countries that have submitted the case of the downing of the Ukrainian flight PS752 to the International Court of Justice for the sake of justice, there are some points that are unclear:
-The legal grounds for the applicant’s claim are on the Montreal Convention of 1971, articles 1, 6, 7, 10, 11 and 13. According to this application, the I.R. of Iran has violated a series of obligations owed to the Applicants under the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, known as Montreal Convention. The unclear point is that this convention holds ONLY individual persons responsible for committing a wrongful act against the safety of the civil aviation, and cannot do justice to the victims lost their lives in the tragic shooting down of the flight buy the missiles of the Islamic Revolutionary Guard Corps. This missing point in this claim is that it ignores the Chicago Convention of 1944 holding states (and not necessarily individual persons) responsible for the use of WEAPONS against civil aviation. Article 3bis of the Convention states:
The contracting States recognize that every State must refrain from resorting to the use of weapons against civil aircraft in flight (emphasis added) and that, in case of interception, the lives of persons on board and the safety of aircraft must not be endangered. This provision shall not be interpreted as modifying in any way the rights and obligations of States set forth in the Charter of the United Nations.
The blind point in the claim is that if the I.R. of Iran accepts the order of the court, only persons in charge of the crime must be persecuted. The I.R. of Iran has already announced that 10 personals of the Islamic Revolutionary Guard Corps have been prosecuted.[1] In this case, there remain no grounds for the proceedings instituted by the four countries at the ICJ.[2]
Here is that a reference to article 3bis of the Chicago Convention urges referencing. The use of WEAPONS against a civil aircraft involves a criminal responsibility of a state (and not and individual). It must be noted that the Montreal Convention includes no provision regarding the use of weapons against a civil aircraft. This means that the application by the four countries has reduce the responsibility of the I.R. of Iran to a legal case, and consequently, ignored the criminal responsibility of the intentional and willful shooting[3] of the flights PS 752.
-The use of weapons in a time escalation of a tension between the I.R. of Iran and the USA arising from targeting and killing of the General Qasem Soleimani by a U.S. drone strike near the Baghdad International Airport in Iraq on 3 January 2020, raises another concern. In this time of crisis, the point of reference in the application instituting proceedings by four countries against the I.R. of Iran, must be the article 52 of Protocol I to the Geneva Convention”. Civilian objects shall not be the object of attack or of reprisals. Civilian objects are all objects which are not military objectives as defined in paragraph 2”.[۴]
The said article passes being inti a jus cogens norm from which no derogation if permitted. The supporting argument is that it violates a prohibition of weapons against targeting civilian targets such as the civilian aircraft. Indeed, in the context outside of war, a fortiori no weapons should be used against a civilian object. Here is that this article, by its compelling content is connected to article 3bis of the Chicago Convention. These two articles provide an appealing reference to the criminal aspect of the shooting down of the flight PS752. Article 1 of the Montreal Convention is NOT a solid ground in condemning the intentional wrongful act of the I.R. of Iran.
-In line with the legal obligation of states stipulated in article 3bis of the Chicago Convention, the UN Security Council in resolution 1067, 1996 also confirmed that violation of such a legal and normative obligation is a reach of international law:
States must refrain from the use of weapons against civil aircraft in flight and that, when intercepting civil aircraft, the lives of persons on board and the safety of the aircraft must not be endangered.[5]
According to the said resolution, all parties must acknowledge and comply with international civil aviation law and related internationally agreed procedures, including the rules and standards and recommended practices set out in the Chicago Convention. The resolution also reminds the elementary considerations of humanity, the rules of customary international law as codified in article 3bis of the Chicago Convention, and the standards and recommended practices set out in the annexes of the Convention. Security Council urges all States which have not yet done so to ratify as soon as possible the Protocol adding article 3 bis to the Chicago Convention.[6]
-Although international law acknowledges the principle of appurtenance, stipulated in article 1 of the Chicago Convention,[7] Iran could impose restrictions on the use of the airspace in the time of crisis and tension in which an immanent attack was possible. Iran should have determined which routes and at which minimum altitude aircraft may fly within that airspace. The UN Special Rapporteur in the report dated 24 December 2020, quotes the IRCG Aerospace Force Commander reportedly indicated after the strike “we had repeatedly demanded that the country’s airspace be suspended from flights”. However, this did not happen, and flights continued. According to the same report, the Iranian government did not issue a Notice of Airmen (NOTAM) or other notice about potential military dangers at Imam Khomeini Airport.[8] These issues have also been ignored in the proceedings instituted at the ICJ by the four countries.
-The Annexes to the Chicago Convention set forth standards for ensuring the safety of civilian flights, including design of the proper training programmes for personals with the purpose of improving safe operating practices.[9] The Government of Iran is in failure of complying with these provisions requiring an assessment of the potential hazards. The government of Iran should also have to determine which are safe for the civil aviation. In accordance with the Draft Articles on State Responsibility for the Internationally Wrongful Acts[10], such failure constitutes responsibility of the state (and not a person identified by the Montreal Convention).[11]
-The ICJ in the Military and Paramilitary Activities in and against Nicaragua reminded the rules of customary international law emphasizing the elementary considerations of humanity which are more exacting in the time of peace than war. This is among the principles of international law applicable to the safety of civilian objects. “Certain general and well recognized principles, namely: elementary considerations of humanity, even more exacting in peace than in war”.[۱۲] The I.R. of Iran is in the charge of the flagrant omission (or violation) of the principles of international law confirmed by the judicial practices of the ICJ.
-Special Advisor to the Prime Minister of Canada, the honorable Mr. Ralph Goodale in his report confirms that Canada will also continue to work vigorously to find some measure of justice (emphasis added) by pursuing full reparations from Iran for the victims, their grieving families and the affected states.[13] He highlights downing of the flight which is absolutely a flagrant violation of international law as specified in article 3bis of the Chicago Convention as well as the UN Security Council resolution 1067 emphasizing use of weapons against the civil aircraft. This report is clear evidence of an international crime committed against the civil aircraft and NOT a mere aerial incidence.

I believe that the said application lacks strong legal grounds against the I.R. of Iran for the shooting down of the flight PS752. Indeed, the scope of the issue is wider than the legal grounds explicated in the application by the four states. Indeed, the reference to the Montreal Convention is one of the number of grounds. The other grounds, mentioned above, are entirely missing in the application instituted against the I.R. of Iran. This could have adverse impacts on the rights of the families of the victims of the downed flight, and hence cannot do justice to the wrongful act by the I.R. of Iran.
I humbly request an explanation of the reasons for not covering the above reasons in the applicationd against the I.R. of Iran. Often Canadian Iranians as well as other Iranians living abroad urge me an explanation of the case. I must provide a clear response to their request.
